The company DIGITAL PROVIDER SA, hereinafter referred to as DIGITAL PROVIDER, through its website WWW.DIGEA.GR, hereinafter referred to as WWW.DIGEA.GR, shall provide services or/ and information under the following terms of use, which visitors (hereinafter referred to as Users) are invited to read carefully and proceed with navigating/ using its pages/ services with the express condition of full acceptance of these terms. Any use of the site automatically implies acceptance of the said terms.

Users of WWW.DIGEA.GR shall, on the one hand, comply with the terms and provisions of the Greek, EU and international Law and the respective legislation governing telecommunications and, on the other hand, refrain from any unlawful and abusive use of the contents and services provided by WWW.DIGEA.GR. In addition, Users shall conduct themselves duly, properly and lawfully during their visit and use of the website, committed not to engage into unfair competition practices or other practices contrary to the NETIQUETTE (network etiquette). Users shall be solely and exclusively liable for any damages caused to WWW.DIGEA.GR, which arise from the improper or unlawful use of the relevant services.

WWW.DIGEA.GR shall not control the availability, contents, personal information protection policy, quality and completeness of the services of other web pages to which the site refers through hyperlinks or banners. As a consequence, for any problems that may arise during their visit/ use thereof, Users shall directly revert to the respective web pages, which are fully liable for the provision of their services. WWW.DIGEA.GR may not, under any circumstances, be deemed as adopting or accepting the contents or services of the web pages, to which it refers to or connects with, in any other manner whatsoever.

Any data collected by DIGITAL PROVIDER may not be disclosed to third parties at any time (except where provided by Law, solely to the competent authorities) and their personal nature shall be safeguarded. WWW.DIGEA.GR shall retain files with such data exclusively for communication, cooperation and statistical reasons as well as for the enhancement of the services provided by the same.

Specifically, in regards to forum and message board hosting services, WWW.DIGEA.GR may record the messages sent by users/ visitors for the purpose of ascertaining whether or not the present terms are infringed; however, it may not, under any circumstances, disclose the contents of these files to third parties.

The overall contents, information and services provided by WWW.DIGEA.GR shall be exclusively owned by said site, unless stated expressly that these originate from third parties. Any intellectual creation incorporated on the web page of WWW.DIGEA.GR shall be owned by DIGITAL PROVIDER and by persons or entities in accordance with the applicable legislation on intellectual property. Under no circumstances may the overall contents and services of WWW.DIGEA.GR be provided to its Users for any reason other than exclusively for their personal use.

The contents of WWW.DIGEA.GR are of informative nature - however, users may not rely upon the undertakings and information included on said site, and DIGITAL PROVIDER shall not be liable in any manner whatsoever in the event that any of the information included in WWW.DIGEA.GR proves inaccurate. In particular, it may not be held liable for any direct or/and consequential damages incurred by the Users of WWW.DIGEA.GR. In any event, it shall make all reasonable effort to ensure that all information included in or originating from WWW.DIGEA.GR is accurate. Furthermore, DIGITAL PROVIDER shall not be liable in any manner whatsoever for any information, news and data originating from third parties.

In the event that any actions or claims of administrative or judicial nature that arise from any form of infringement by Users are filed or raised against DIGITAL PROVIDER, the said User shall undertake to intervene in the respective proceedings that are initiated and indemnify WWW.DIGEA.GR if the latter is forced to pay damages or other expenses.

Users agree not to make use of the services provided by WWW.DIGEA.GR for the purposes of:

1.Posting, publishing, sending, transferring or using any other methods for installing contents that are illegal, harmful or damaging, threatening, extorting, insulting, defamatory, obscene, violent, offensive, racist, sexist or otherwise reproachful, offensive to the personality and violate personal information of other parties, cause sentiments of hate or/and constitute the base of other criminal offences;
2.Harming minors in any manner whatsoever;
3.Taking the identity of any legal entity or natural person or making false statements on the identity of a user/ member or misleading statements in regards to the relationship or/ and cooperation between a user/ member and any other legal entities or natural persons;
4.Falsifying or otherwise altering the usernames of users/ members in order to mislead as to the origin of the contents that are transmitted through WWW.DIGEA.GR;
5.Posting, publishing, sending, transferring or using any other methods for installing contents from persons that are not entitled to disclose such contents as stipulated by law or under any relationship of confidential nature;
6.Posting, publishing, sending, transferring or using any other methods for installing software or contents of any form (text, image, audio, video, animation) that infringe intellectual property rights of any entity (including trade secrets);
7.Posting, publishing, sending, transferring or using any other methods for installing unsolicited or unauthorized advertising or other mails that promote products or other contents and, in general, unsolicited mail (spam or junk mail);
8.Posting, publishing, sending, transferring or using any other methods for installing or/ and promoting or/ and providing contents that comprise digital viruses or any other electronic codes, files or software designed to jam, destroy or limit the function of any software or PC equipment or telecommunications equipment;
9.Jamming or breaching services or servers or networks that are connected with WWW.DIGEA.GR, or violating the requirements, procedures and rules for the use of such networks;
10.Infringing, intentionally or unintentionally, any local, national, European, international legislation or/ and any applicable rules which pertain or/ and govern any services provided by WWW.DIGEA.GR;
11.Harassing in any manner whatsoever the private life and violating the individual and social rights of other users (through collecting or storing other users' personal information).

Through the website WWW.DIGEA.GR, DIGITAL PROVIDER shall provide Users with the option to express their opinions on topical issues, which shall be phrased as questions. The answers of the participating users shall be recorded, analyzed and commented by WWW.DIGEA.GR so that conclusions may be inferred as to public opinion trends in connection with the specific issues that are raised. DIGITAL PROVIDER shall reserve the exclusive right to collect and utilize these data, and any conclusions and findings based on such data shall be DIGITAL PROVIDER’s intellectual property.

Users of WWW.DIGEA.GR accept that DIGITAL PROVIDER shall not engage into any preliminary monitoring of the contents, but DIGITAL PROVIDER and its competent partners and associates shall reserve the right (not the obligation) to refuse, at their sole discretion, to post/ publish or move or delete any contents available through WWW.DIGEA.GR. In addition, DIGITAL PROVIDER and its competent partners/ associates shall reserve the right to delete any contents that are in breach of the present terms of use. Users accept that they shall assess and be responsible for any risks which the use of any contents may entail, including their decision to rely upon the correctness, completeness and usefulness of any contents. Within this context, Users accept that they may not rely upon the contents created by or posted on WWW.DIGEA.GR or rely on user pages and any and all other services offered by WWW.DIGEA.GR.

DIGITAL PROVIDER shall reserve the right to modify or/ and suspend temporarily or permanently its services, in whole or in part, with or without notification to the Users.

Except for the intellectual property rights of third parties, partners/ associates and entities, the entire contents of WWW.DIGEA.GR, including images, graphics, photos, designs, texts, services provided and, in general, all of its files shall be the intellectual property of DIGITAL PROVIDER and, in addition to DIGITAL PROVIDER’s trademarks, they shall be protected by the respective provisions of the Greek and the EU law and of international conventions and agreements. Consequently, neither of the foregoing may become, in whole or in part, the object of sale, copying, modification, reproduction, republication nor be posted, uploaded, transmitted or distributed in any manner whatsoever, with the exception of the single storage of one and only copy of part of the contents in a simple PC, for personal - not for public or commercial - use, without deleting any DIGITAL PROVIDER labels or trademarks and without infringing in any manner whatsoever the respective intellectual and industrial property rights. Other products or services that are mentioned in WWW.DIGEA.GR and bear the trademarks of respective corporations, companies, cooperating agencies, associations or publications shall constitute the intellectual and industrial property of the said parties, with such parties bearing the respective responsibility/ liability. Users understand and accept that they shall not be provided with the right to reproduce, copy, sell, resell or/ and commercially exploit in any manner whatsoever any part of or the entire contents of WWW.DIGEA.GR.

This license agreement shall be governed by the provisions of the Greek Law, the directives and regulations of EU Law and the relevant international provisions and codes of ethics, whereas it shall be interpreted based on the rules of good faith, fair trading practices and the economic and social objective of said right of use.

In the event that any provision is deemed contrary to the law and, as such, is void or voidable, said provision shall cease to apply by operation of law, without affecting under any circumstances the validity of the remaining terms.

No modifications to the terms of this agreement shall be deemed effective unless stated in writing and incorporated in the agreement.

For any disputes that may arise from or in connection with the agreement, the parties submit to the jurisdiction of the Courts of Athens.
